Warranty, returns, shipping, and payment terms for orders placed at shop.splayometer.com.

These Terms of Sale (“Terms”) govern your purchase of the Splayometer™ Digital Unit, Clinical Kit, and accessories (collectively, “Product”) from Metric Devices through shop.splayometer.com. By placing an order, you agree to these Terms.

1. Order acceptance and pricing

Your order constitutes an offer to purchase. Metric Devices may accept or decline any order at its discretion, including for reasons of stock availability, pricing or product description errors, or suspected fraud. Acceptance occurs when we charge your payment method and confirm shipment.

All prices are listed in U.S. dollars and exclude shipping and applicable taxes. Prices may change without notice; the price in effect at the time your order is accepted applies.

2. Payment

Payments are processed by Square, Inc. By submitting payment information, you authorize Metric Devices to charge the applicable amount, including any taxes and shipping. Card details are entered directly into Square’s secure form and are never stored on our servers.

For backordered items, your card may be saved on file via Square and charged when the item ships. You will receive an email confirmation at each step.

3. Shipping

We currently ship within the United States only. Standard flat-rate shipping is $5.95; orders of $500 or more ship free. Most orders ship within 3 business days of order acceptance. Delivery time depends on the carrier and destination and is not guaranteed.

Shipping risk transfers to you upon delivery. You are responsible for providing an accurate shipping address; we are not liable for losses or delays caused by incorrect address information.

4. Sales tax

Sales tax is collected on orders shipped to states where Metric Devices is required to collect it under applicable law. Tax, when applicable, is calculated at checkout based on your shipping address and the products in your order.

5. Limited Warranty

Metric Devices warrants the Splayometer™ Digital Unit and Clinical Kit (collectively, the “Product”) against defects in materials and workmanship under normal use for a period of one (1) year from the original date of purchase (“Warranty Period”). This is a Limited Warranty as defined by the Magnuson-Moss Warranty Act (15 U.S.C. §§ 2301–2312).

This warranty applies only to the original purchaser and is not transferable. It covers the Product as shipped by Metric Devices, including the digital measurement unit, load cell sensor assembly, and any accessories included in the purchased configuration (e.g., calibration weight, USB-C cable, and charger for Clinical Kit purchases).

6. Implied warranties

In addition to this express Limited Warranty, you have rights under implied warranties, including the implied warranty of merchantability and, where applicable, the implied warranty of fitness for a particular purpose. Under Massachusetts law (M.G.L. c. 106, § 2-316A), implied warranties cannot be disclaimed or excluded in consumer transactions, and this policy does not attempt to do so. Your implied warranty rights are fully preserved.

The duration of any implied warranty is limited to the duration of this express Limited Warranty (one year), to the extent permitted by applicable law. Some states do not allow limitations on the duration of implied warranties, so this limitation may not apply to you.

7. What is covered

During the Warranty Period, if the Product exhibits a defect in materials or workmanship under normal and intended use, Metric Devices will, at its sole discretion:

The remedy chosen will be at the sole discretion of Metric Devices based on the nature of the defect, parts availability, and other relevant factors. Metric Devices maintains repair and service capabilities at its facility in Nahant, Massachusetts, and will complete warranty service within a reasonable time.

These exclusions apply to the express Limited Warranty only. They do not limit your rights under implied warranties or other applicable law.

9. How to make a warranty claim

To initiate a warranty claim, contact Metric Devices at support@splayometer.com. Please have the following information ready:

Metric Devices will provide a Return Merchandise Authorization (RMA) number and shipping instructions. Products sent without an RMA number may be refused or returned to sender.

Shipping: The customer is responsible for shipping costs to Metric Devices. We will cover return shipping for all warranty-approved repairs and replacements.

10. Return policy

If you are not satisfied with your purchase for any reason, you may return the Product within thirty (30) days of the delivery date for a full refund of the purchase price.

To qualify for a return:

Refund processing: Refunds will be issued to the original payment method within 10 business days of receiving and inspecting the returned Product. No restocking fee applies.

Return shipping: The customer is responsible for return shipping costs on non-defective returns. We recommend using a trackable shipping method, as Metric Devices is not responsible for items lost in transit.

11. Exchanges

If you received a defective or damaged Product, contact us within 30 days of delivery and we will ship a replacement at no additional cost. Defective exchanges follow the warranty claim process described in Section 9.

12. Limitation of liability

To the maximum extent permitted by applicable law, Metric Devices shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use or inability to use the Product, including but not limited to loss of data, lost profits, or business interruption, regardless of whether such damages are based on warranty, contract, tort, or any other legal theory.

Nothing in this policy limits or excludes liability for personal injury caused by a defective Product. Under Massachusetts law (M.G.L. c. 106, § 2-719), limitation of consequential damages for injury to the person in the case of consumer goods is prima facie unconscionable.

Except as stated above, the total liability of Metric Devices under this warranty shall not exceed the original purchase price of the Product.

13. Dispute resolution

If you are dissatisfied with a warranty decision, you may request that Metric Devices escalate your claim for a second review. We are committed to resolving warranty disputes fairly and promptly. You also retain all rights available to you under Massachusetts law, including but not limited to the protections of the Massachusetts Consumer Protection Act (M.G.L. c. 93A).

14. Your legal rights

These Terms give you specific legal rights. You may also have other rights that vary by state. In particular, Massachusetts consumers have rights under the Uniform Commercial Code (M.G.L. c. 106) and the Massachusetts Consumer Protection Act (M.G.L. c. 93A) that cannot be waived or limited by these Terms. Nothing in this document is intended to limit those rights.

15. Governing law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws provisions. Any dispute arising out of or relating to these Terms or your purchase shall be subject to the exclusive jurisdiction of the state and federal courts located in Massachusetts.

16. Pre-purchase availability

In accordance with the Magnuson-Moss Warranty Act, this warranty is made available to consumers prior to purchase at splayometer.com and upon request by contacting Metric Devices.

17. Modifications

Metric Devices may update these Terms from time to time. The version in effect at the time of your purchase applies to your transaction. The current version is always posted at this page.
